GENERAL TERMS AND CONDITIONS OF SALE – MAISON MONTAGUT

ARTICLE 1 – GENERAL PROVISIONS

1.1 – Scope of application

These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all sales concluded by BONNETERIE CEVENOLE for its Maison Montagut brand , SAS with capital of 1870,596.00 Euros, having its registered office at 1001 avenue de la République, 07500 Guilherand-Granges, France, and registered with the RCS of AUBENAS under number 35 620 282 R.C.S (hereinafter "MAISON MONTAGUT"), from end consumers wishing to acquire the products marketed on the site https://montagut.com exclusively for their personal needs and not for commercial, intermediary or resale purposes (hereinafter "The Customer").

The Customer acknowledges that he/she is acting as a consumer and that he/she does not intend to resell Maison Montagut items for commercial purposes. He/she also certifies that he/she has the legal capacity to contract and purchase on the site.

1.2 – Acceptance of the General Terms and Conditions of Sale

Any order placed on the site https://montagut.com implies unconditional acceptance of these General Terms and Conditions. They are accessible at any time on the site and prevail over any other contradictory document.

By validating his order, the Customer acknowledges having read these General Terms and Conditions and having accepted them without restriction or reservation.



ARTICLE 2 – PRODUCT INFORMATION

The products offered for sale on the site https://montagut.com are textile items and fashion accessories for Women, Men and Children.

The main characteristics of the products, including the descriptions, illustrations and compositions, are presented on the site. Maison Montagut makes every effort to guarantee the accuracy of the visuals and descriptions, but cannot ensure perfect similarity due to variations in screen display.

The Customer is required to read the descriptions before placing an order.



ARTICLE 3 – ORDERS

3.1 – Order process

The Customer selects the products of their choice, which are added to the basket. They can modify their basket before final validation of the order.

Before final validation, an order summary is displayed, allowing the Customer to check and correct any errors.

3.2 – Validation and confirmation of the order

Once the order has been validated and paid, a confirmation email is sent to the Customer. The sale is then considered final.

Maison Montagut reserves the right to cancel or refuse any order in the event of a dispute with the Customer, suspicion of fraud, or obvious error in the price displayed.



ARTICLE 4 – PRICE AND PAYMENT

4.1 – Product prices

Product prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs. These fees are communicated before the order is validated.

Maison Montagut reserves the right to modify its prices at any time, but the products will be billed at the rate in effect at the time the order is validated.

4.2 – Payment terms

Payment is due immediately upon ordering and can be made via:

  • Bank card (Visa, Mastercard, American Express)
  • PayPal
  • SCALAPAY (payment in 3 installments without fees)

In the event of refusal of payment by the banking establishment, the order cannot be finalized.



ARTICLE 5 – DELIVERY

Orders are delivered to the address indicated by the Customer according to the options available at the time of purchase.

Delivery times are indicated for information purposes only and may vary depending on the carrier and the country of destination.

In the event of a delay, Maison Montagut undertakes to keep the Customer informed and to propose an appropriate solution.



ARTICLE 6 – RIGHT OF WITHDRAWAL AND RETURNS

In accordance with Article L.221-18 of the French Consumer Code, the Customer has 14 days from receipt of the products to exercise their right of withdrawal.

Return terms:

  • Products must be returned in their original condition, unworn and unwashed.
    Return costs are the responsibility of the Customer, except in the event of an error by Maison Montagut.
    Once the return has been received and validated, the refund will be made within 15 days via the initial payment method.

ARTICLE 7 – LEGAL GUARANTEE OF CONFORMITY

The products sold benefit from the 2-year legal guarantee of conformity from receipt of the items, in accordance with articles L.217-4 to L.217-14 of the Consumer Code.

In the event of a non-compliant or defective product, the Customer may request:
A repair or exchange
A refund if no solution is possible

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

When the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee is applicable to this digital content or this digital service throughout the planned supply period. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date on which it appeared.

The legal guarantee of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to the repair or replacement of the good within thirty days of his request, free of charge and without major inconvenience for him.

If the good is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the good, but the seller imposes the replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the good.

The consumer may obtain a reduction in the purchase price by keeping the good or terminate the contract by being fully reimbursed against return of the good, if:
1° The professional refuses to repair or replace the good;
2° The repair or replacement of the good occurs after a period of thirty days;
3° The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-compliant good, or if he bears the costs installation costs of the repaired or replacement goods;
4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction in the price of the goods or to the termination of the contract when the lack of conformity is so serious that it justifies the reduction in the price or the termination of the contract being immediate. The consumer is then not required to request the repair or replacement of the goods in advance.

The consumer is not entitled to the termination of the sale if the lack of conformity is minor. Any period of immobilization of the goods with a view to their repair or replacement suspends the warranty which remained to run until the delivery of the repaired goods.

The rights mentioned above result from the application of the articles L. 217-1 to L. 217-32 of the Consumer Code.

The seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of a maximum amount of 300,000 euros, which may be increased to 10% of the average annual turnover (Article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee of hidden defects in application of Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles you to a price reduction if the item is kept or to a full refund upon return of the item.



ARTICLE 8 – PROTECTION OF PERSONAL DATA

Maison Montagut collects personal data only for order management and customer relations. This information will not be resold to third parties.

ARTICLE 11 – APPLICABLE LAW & COMPETENT JURISDICTION

These General Terms and Conditions are governed by French law. In the event of a dispute, the competent courts will be those of the Customer's domicile or the place of delivery of the product.
